17.1 Definitions
17.2
Involuntary Transfer:
An involuntary change of teaching site (school).
Reassignment:
A change of grade level or subject area without a site (school) change.
Transfer:
A change of teaching site (school).
Vacancy:
A position which the District expects to fill but is not presently staffed
due to a resignation, retirement, or the establishment of a new position.
Eliminated Position/Program:
A position/program discontinued by the school/district.
17.2 Reassignment
17.2.1
The authority for reassignment of a teacher to a different grade level or a
different subject matter area, but not involving a site change, shall rest
with the site administrator. The site administrator will submit to the teacher,
in writing, the reason for the reassignment.
17.3 Voluntary Transfers:
Any certificated employee who desires a transfer may submit a request to the
Director, Personnel Services, through his/her administrator. Such request may
be submitted at any time during the school year. However, it is anticipated
that all transfer requests shall be implemented on the basis of the projections
for the Fall Semester.
17.3.1
Teachers requesting voluntary transfer shall specify the types of assignments
they are willing to accept and the subjects they are qualified
17.3.2 to teach:
Group interviews will be arranges with principals by the Director of Personnel
so as to minimize the number of times teachers will be interviewed. Interviews
will be arranged for those teachers who best meet the qualifications of the
position.
17.4 Vacancies:
The District shall advise the staff of vacancies as they occur. Vacancies shall
be posted by the Personnel Office for at least five (5) working days in each
building and work site. Such notice shall include the job description, location,
grade

level or subject matter assignment, credential requirements, and date by which
position is to be filled.
17.4.1
Mid-year vacancies may be filled by personnel hired from outside the District.
However, District teachers who apply for those mid-year vacancies will have
first consideration for said positions in the Fall, except when the positions
require special credentials and/or special qualifications.
17.5
Denied Transfer or Reassignment: Upon request by the applicant, he/she will
be given a written rationale for the denial.
17.5.1 Transfer Appeal Process:
Teachers who have 5 years experience in the district and who have been denied
voluntary transfer to at least two positions, may request transfer to a different
site by administrative placement. The request must be made to the Director
of Personnel in writing before January 31 of each school year. The teacher
must specify the types of assignments they are qualified to teach. The Director
of Personnel will interview the teacher and make an administrative placement
at another site where a vacancy exists.
17.5.2
If a teacher refuses to accept an administrative placement, they may not request
another administrative placement for three (3) years from the time the previous
placement was refused.
17.5.3
If an administrative placement is granted, the teacher may be evaluated during
the next year. The teacher may not request another administrative placement
for three (3) years from the time a previous request was granted.
17.6
Involuntary Transfers: A certificated employee who is to be involuntarily transferred
shall be given the reasons in writing for the impending transfer.
17.6.1
Considering involuntary transfers of certificated employees - The Superintendent
will take into consideration:
a. Credential held
b. Experience
c. Recommendation of site administrator(s)
d. Major and/or minor field of study
e. Seniority

17.6.2
If an employee is involuntarily transferred after the beginning of a school
year (students in attendance), said teacher will be given two (2) days of release
time to prepare for and make the move.
17.6.3
The Superintendent upon request of the site administrator may grant additional
release time. The District shall provide for the movement of all materials
from one assignment to another.
17.6.4
Certificated employees who are involuntarily transferred have the right to
indicate preference from a list of vacancies.
17.7
Eliminated Position/Program: A tenured teacher, who must seek a new assignment
in the District due to school site and/or District elimination of a program,
has the right to indicate preference from a list of vacancies. Said teacher
must have the proper credentials and qualifications to fill the position being
sought. The teacher will be notified by the District of the pending elimination
of program.
17.8
General: The list in Article 17.601 is not intended to be all-inclusive and
the Superintendent will make the final determination for all transfers.
17.8.1
Exceptions to this regulation may be made only in extenuating circumstances
and must benefit the individual school or the district as a whole. Exceptions
shall not be made arbitrarily, capriciously or without good and sufficient
cause.
