ARTICLE 22: YEAR ROUND EDUCATION PROGRAM

22.1 Work Year and Calendar:
The Year Round Education Program for K 6 elementary schools shall be a multi track calendar of approximately 60 student attendance days/20 non attendance days (60/20).
The work year for teachers in the Year Round Education Program shall be as follows:

a. New teacher 60/20 Year round = 183 days
(176 instructional days 7 non instructional days)
b. Year Round 60/20 = 181 days
(176 instructional days 5 non instructional days)

The YRE work year represents four (4) less days than the traditional calendar. Therefore, the instructional minutes per day must be increased to comply with Education Code Section 37670.

22.2 Teacher Workday

22.2.1
The District may take any action to ensure compliance with all incentive provisions in Education Code Sections 46200 46204 concerning days of instruction for students and amounts of instructional time.

22.2.2
Teachers shall not be required to attend in-services or meetings during their off track time. Participation in faculty and specialist's meetings during periods of intercession shall be considered voluntary. If a member wishes to attend such meetings, attendance would be without pay. Certain meetings held during intersession may be deemed significant meetings by management. Members who are asked and voluntarily attend shall be paid at their daily rate or given compensatory time off.

22.2.3
Teachers working in a school not on a year round calendar will not be required to work beyond their regular work day as a result of additional instructional minutes being added at the YRE sites.

22.3 Exchange Days

22.3.1
Teachers assigned to a Year Round school shall be eligible for exchange days subject to the following conditions:

a. A maximum of ten (10) days per school year will be allowed for each teacher with approval of the site administrator. The reason for the absence will not be a factor in the denial of an exchange day.
b. It is the responsibility of the teachers involved in the trade to demonstrate and maintain continuity of the instructional program.
c. Teachers must apply to the site administrator two full working days prior to the desired exchange. The request shall contain both unit members signature.
d. All trades must be completed within the same school year.
e. If the teacher who is responsible for being in that classroom should be absent because of illness, the sick leave shall be charged to that teacher.
f. The District and/or Association bear no responsibility for the enforcement of exchange day agreements between individual teachers nor shall the District or Association be liable for the payment of additional compensation based upon any teacher working beyond his/her regular work year pursuant to any exchange day agreement.

22.4 Initial Track Assignments:
For implementation of year round school programs, the site administrator shall assign teachers to tracks according to the following procedures:

22.4.1
Teachers wanting a transfer out of a year round school will have first priority for any district openings. These teachers will have the right to indicate a preference from a list of vacancies. This will occur after reassignments are made at the site but before teachers at other sites are considered.

22.4.2
Teachers will meet by grade level and attempt to reach agreement on track assignment. Combination class teachers can choose which grade level to meet with if there will be openings at both grade levels. If an agreement cannot be reached, the principal will assign disputed tracks according to the reassignment criteria set forth in Article 17 of the Contract.

22.4.3
Teachers within the year round school shall be given first priority to reassignments to other tracks within their grade level. Reassignment to another grade level at their school shall be done in accordance with Article 17.201 of the Contract.

22.4.4
Children of teachers, who are attending a year round school in the District, will be given first priority for track placement, if requested in writing.

22.4.5
Teachers who transfer out of a Year Round site and change grade levels will have the option of participating in the District Language Acquisition Training Program.

22.5 Transfers:
Track assignments and notification for the following school year will be completed prior to March 1. Teachers at a site will be provided first consideration for an opening at that site for a different track for the subsequent school year.

22.6 Teacher Compensation

22.6.1
Teacher on non workdays will be given first consideration to substitute at their sites if they have notified the District in advance that they will definitely accept a substitute assignment on the specified date(s). Pay shall be at the current daily substitute rate plus $10.00. Teachers who substitute more than five consecutive days shall be paid at their per diem rate.

22.602
Teachers working in the Year Round Education Program shall be paid in twelve (12) equal payments.

22.7 Maintenance of Benefits:
Teachers assigned to the Year Round Education Program will be provided with the opportunity to serve as mentor teachers, participate on district committees, SIP activities, district in services, Curriculum and Instruction Council or any leaves specified in the Contract.

22.8 Auxiliary Personnel

22.8.1
Resource specialists, music teachers, speech therapists, and any other specialists may extend or vary their work year if mutually agreed between the employee and the district. Any extensions of the contract will be a pro rata increase in salaries for the additional contract days.

22.8.2
Teachers will be credited with one additional illness leave day for each eighteen (18) additional days worked as a result of an extended contract.

22.9 Working Conditions

22.9.1
Air conditioning and heating will be provided in each classroom in the Year Round Education Program.

22.9.2
Portable storage cabinets shall be provided to each teacher in the Year Round Education Program who must move to another classroom.

22.9.3
Assistance in moving student and teacher portable storage cabinets and other materials designated by the site administrator shall be provided when a teacher must move to another room.

22.9.4 There will be no roving teachers.

22.9.5
All tracks will have equal access to auxiliary personnel. If necessary personnel are not available, this provision will be temporarily suspended until the District is able to secure the necessary services.

22.9.6
In cases where adequate space is available, special consideration will be given to not rotating kindergarten or special day classes. When adequate space is not available, the District and the Association will request a waiver from the State Board of Education to operate double session kindergartens.

22.10 Evaluation Timelines:
The evaluation schedule for probationary and permanent employees will be adjusted for each track. The events will be adjusted to occur at the same number of days from the beginning of the track as they do for traditional calendar employees. All evaluations will be completed at least 30 days prior to the end of a track for the current school year.

22.11 Leaves of Absence:
Teachers shall be eligible for unpaid leaves of absence for up to one session (60 days) of track assignment. Leave requests must be submitted at least four (4) weeks prior to the first day of leave.

22.12 Notice to Terminate Year Round Education Program:
The District shall agree to give a minimum of one (1) year prior notice to all Year Round School teachers should the elimination of Year Round Schools occur. In the event that one (1) year prior notice is not possible, the District shall maintain the twelve (12) calendar months pay period for one (1) year following such change, at the teacher's request.

22.13 Inclusion Clause:
All items not specifically addressed in this addendum will be governed by the Certificated Master Contact.
