ARTICLE 23: CONTRACT CLAUSES
23.1 Terms and Conditions:
The terms and conditions set forth in this Agreement represent the full and
complete understanding between the parties hereto. The terms and conditions
may be altered, changed, added to, deleted from, or modified only through the
voluntary, mutual consent of the parties in a written amendment executed according
to the provisions of this Agreement. This Agreement terminates and supersedes
those past practices, agreements, procedures, traditions, and rules or regulations
inconsistent with any matters covered herein. The parties agree that during
the negotiations which culminated in this Agreement, each party enjoyed and
exercised without restraint, coercion, intimidation, or other limitation, the
right and opportunity to make demands and proposals or counter proposals with
respect to any matter not reserved by policy or law from compromise through
negotiations and that the understandings and agreements arrived at after the
exercise of that right and opportunity are set forth herein.
23.2 Educational Innovations:
If any Association member(s) or the majority of any school site staff wish
to pursue an educational innovation in order to better serve students, but
is prohibited by the Agreement, both the Atwater Elementary Teachers Association
Executive Board and the Superintendent must approve the action in writing
prior to implementation.
