ARTICLE 9: EVALUATION Revised: September, 2004


9.1 General Provisions.
The chief responsibility for formal teacher evaluation shall be that of the principal or supervisor; however, this responsibility may be shared with the Superintendent, an administrator designated by the Superintendent, and/or other qualified consultants.

9.1.1
Evaluation techniques and evaluation criteria will be left to the reasonable discretion of the District. The California Standards for the Teaching Profession may serve as the criteria for evaluation beginning in the 2005-2006 school year. The District will consult with the Association prior to changing the evaluation form.

9.1.2
Teachers are required to sign all formal written evaluations (Assessments and Summaries). Teachers do not sign that they agree with the evaluation, but rather that they have read it. Teachers are to receive a copy of all evaluations. Hearsay statements shall be excluded from written evaluations. Teachers shall examine, sign and date the evaluation forms. Signature does not indicate approval or disapproval. Teachers have a right to initiate a written reaction or response to the evaluation. Such a response shall become a permanent attachment to the evaluation in the teacher’s personnel file.

9.1.3
Any teacher who does not meet one or more Standard may request and be entitled to, subsequent observations, conferences, and written evaluations (Assessments or Summaries).

9.1.4
The teacher's evaluator shall take action to provide Strategies for Assistance for any Standard not met. Such action shall include specific recommendations for improvement. The evaluator shall designate a specific performance improvement program to be undertaken when such a need exists. Improvement program requirements for probationary teachers shall be completed and verified by February 15 of the second

probationary year. Improvement program requirements for tenured teachers shall be completed within twelve (12) months from the date of the evaluation in which the
improvement requirements were set forth. All college courses taken as part of the improvement program must be in accordance with the provisions of Article 18, if salary credit is to be earned.

9.1.5
Certificated teachers shall be given a copy of the instruments utilized by the supervisor for the evaluation (Assessments and Summaries) at the beginning of each school year.

9.2 Probationary and Temporary Teachers.
Probationary 1 and 2 teachers shall have at least one Summary Performance Appraisal per year. Evaluations (Assessments/Summaries) shall be based on classroom visitations and upon other factors as provided with E.C. 44664. Temporary teachers will be evaluated on the Probationary schedule. Any Temporary teacher who completes two evaluation cycles will be evaluated using the procedures for permanent teachers.

9.2.1 Probationary 1 Evaluation Schedule:
a) On or before September 15, prior to implementing the evaluation schedule, the supervisor will discuss with the employee the District Standards, methods and procedures for observations, and materials to be collected.
b) On or before October 15, a conference will be held to discuss observed performance (First Assessment/Standard II). The teacher shall receive a copy of the written Assessment.
c) On or before December 15, a conference will be held to discuss observed performance (Second Assessment/ Standards II, III, and IV). The teacher shall receive a copy of the written Assessment.
d) On or before March 15, a conference will be held to discuss performance (Third Assessment/Standard I, II, III, IV, and V). The teacher shall receive a copy of the written Assessment.
e) On or before May 1, a conference will be held to discuss overall performance of all six standards. A Summary Performance Appraisal will be completed and submitted to the Personnel Office. The teacher shall receive a copy of the Summary.

9.2.2 Probationary 2 Evaluation Schedule.
The supervisor and teacher will select Standards to focus upon for each assessment. Between the two Assessments, all Standards will be addressed.
a) On or before September 15, prior to implementing the evaluation schedule, the supervisor will discuss with the employee the District Standards, methods and procedures for observations, and materials to be collected.
b) On or before October 15, a conference will be held to discuss observed performance (First Assessment). The teacher shall receive a copy of the written Assessment.
c) On or before December 15 a conference will be held to discuss observed performance (Second Assessment). The teacher shall receive a copy of the written Assessment.
d) On or before February 15, a conference will be held to discuss overall performance. A Summary Performance Appraisal will be completed and submitted to the Personnel Office. The teacher shall receive a copy of the Summary.

9.3 Permanent (Tenured) Teachers.
Tenured teachers shall have at least one Performance Appraisal every other year. If one or more Standard is not met, the teacher will be evaluated every year until all Standards are attained.

9.3.1 Five Year Option.
Certificated employees with at least ten (10) years of District service who are highly qualified pursuant to ESEA/NCLB, and whose most recent evaluation met or exceeded the Standards, may mutually agree in writing with her/his evaluator to be evaluated at least every five years. The certificated employee or the evaluator may rescind this agreement at any time, but not during the year the evaluation is taking place. If consent is withdrawn by either party, the certificated employee will be evaluated every other year. If a unit member transfers or changes assignments during the five-year period, a new agreement shall be signed if mutual agreement continues. (Ref. Education Code Section 44664.
9.3.2 Permanent Teacher Evaluation Schedule.
a) On or before October 15 a pre-appraisal conference will be held to discuss areas of focus for the year, to establish methods and procedures for observations, and/or types of materials to be collected.

b) On or before December 15 a conference will be held to discuss observations of performance. The teacher shall receive any copies of written assessments.
c) On or before May 1, a conference will be held to discuss overall performance. A Summary Performance Appraisal will be completed and submitted to the Personnel Office. The teacher shall receive a copy of the Summary.

9.4 Peer Assistance and Review Referral .
Permanent teachers who receive an unsatisfactory on two or more of the standards on the Summary Performance Appraisal will be referred to the Peer Assistance and Review (PAR) Program, and the principal will continue the evaluation process until all standards are met.

9.5. Grievance.
Grievances concerning evaluation shall be limited to a claim that the procedures of this article have not been followed.
